Procedures For Establishment Of Real Estate Brokerage Company in Vietnam

Real estate has recently been considered as the good channel for the local and foreign investors. Big corporations over the world have understood and caught up this trend for a long time ago, evidenced by their subsidiaries engaged in real estate brokerage business in Vietnam. The development of the real estate industry is directly proportionate to the development and professionalization of the real estate brokerage business. Understanding these issues, we hereby share the information of procedures for establishment of real estate brokerage company in Vietnam, one of the first and important steps to develop the real estate business.

The real estate brokerage is one of the conditional businesses under the Law on Investment. The conditions of and procedures for establishment of real estate brokerage company are as follows:

1. Conditions of establishment of real estate brokerage company

For the purpose of establishment of real estate brokerage company, the investors are required to meet the following conditions:

  • Being domestic organizations or individuals, or overseas Vietnamese, or foreign organizations or individuals
  • Having at least 02 employees obtaining practising certificates as a real estate broker.

2. Procedures for establishment of real estate brokerage company

2.1 For domestic organizations or individuals, or overseas Vietnamese

  • Step 01: Submitting the dossier of establishment of real estate brokerage company to the Business Registration Office of the Department of Planning and Investment of the location where the company is located. The company will be issued with the Enterprise Registration Certificate;
  • Step 02: Making the stamp and submitting the notification of the stamp sample of the real estate brokerage company;
  • Step 03: Proceeding with post-establishment procedures, including opening the bank accounts, registering the digital signature, declaring and paying the registration fee, etc.

2.2 For foreign organizations or individuals

  • Step 01: Submitting the dossier of registration of the investment project to the Investment Registration Office of the Department of Planning and Investment of the location where the company is located. The investor(s) will be issued with the Investment Registration Certificate;
  • Step 02: Submitting the dossier of establishment of real estate brokerage company to the Business Registration Office of the Department of Planning and Investment of the location where the company is located. The company will be issued with the Enterprise Registration Certificate;
  • Step 03: Making the stamp and submitting the notification of the stamp sample of the real estate brokerage company;
  • Step 04: Proceeding with post-establishment procedures, including opening the bank accounts, registering the digital signature, declaring and paying the registration fee, etc.
